The VAT treatment of transactions involving immovable property often gives rise to a number of practical questions and challenges, including:

  • Determining whether a transaction is subject to VAT, exempt without credit, exempt with credit, or eligible for a reduced rate of VAT
  • Establishing the extent of the right to deduct and recover input VAT, including partial attribution considerations
  • Understanding when adjustments under the Capital Goods Scheme may be required
  • Assessing eligibility for registration under the Small Undertakings Scheme (Article 11)
  • Identifying circumstances in which special VAT mechanisms, including the Tax in Danger provisions, may apply
  • Reviewing any recent or forthcoming legislative, administrative, or jurisprudential developments affecting the sector
