[ONLINE] Crypto Reporting Issues & DAC 8 – Updates and Developments – 18 June

The Council of the European Union issued Directive 2023/2226, known as DAC8, amending Directive 2011/16/EU on 17 October 2023. DAC8 is an EU legislative measure aimed at enhancing tax transparency and combating tax evasion by expanding the scope of mandatory automatic exchange of information between EU member states through the introduction of new reporting obligations for reporting crypto-asset service providers in relation to the use of crypto-assets. DAC8 obliges such service providers to collect and report information on crypto-asset transactions and holdings to tax authorities, thereby enhancing transparency and tackling tax evasion in the crypto sector.

Seminar Description

The Council of the European Union issued Directive 2023/2226, known as DAC8, amending Directive 2011/16/EU on 17 October 2023. DAC8 is an EU legislative measure aimed at enhancing tax transparency and combating tax evasion by expanding the scope of mandatory automatic exchange of information between EU member states through the introduction of new reporting obligations for reporting crypto-asset service providers in relation to the use of crypto-assets. DAC8 obliges such service providers to collect and report information on crypto-asset transactions and holdings to tax authorities, thereby enhancing transparency and tackling tax evasion in the crypto sector.

Agenda –

  • the adoption of DAC8 at an EU level;
  • background around the OECD crypto-asset reporting framework (CARF) and the relevant amendments to Common Reporting Standard (CRS);
  • the interplay between the Markets in Crypto-Assets Regulation (MiCA) and DAC8;
  • the key provisions of DAC8 including, amongst others: obligations of reporting crypto-asset service providers, reporting requirements, due-diligence procedures; and  
  • Malta’s transposition of DAC8.
